DoctorsPlasticSurgery.com and MyDPS.com (collectively, “the Websites”) are owned and administratively operated by Town Group Management LLC (“Town Group”), a management services organization that provides non-clinical administrative, marketing, and business support services to independently owned physician practices, including Town Surgery NY PLLC (“Town Surgery”).
Town Group is not a medical provider and does not furnish medical advice, diagnosis, or treatment. All patient care, clinical decision-making, and medical recordkeeping are performed solely by licensed, board-certified physicians through their professional entities.
By accessing or using the Websites, you acknowledge and agree to this Privacy Policy and the described division of responsibilities between Town Group and the affiliated physician practices.
2. Information We Collect
We may collect the following types of information:
Personal Information – Name, contact details, and other identifiers you voluntarily provide through forms, chat, or email.
Health-Related Information – Information you share about medical history, procedures, or interests. This information is routed securely to licensed physicians and becomes subject to HIPAA once received.

3. How We Use Information
Town Group may use collected information to:

Town Group’s role is strictly administrative. It will never make medical decisions, maintain patient charts for treatment purposes, or replace a consultation with a physician.

With Affiliated Practices: Data may be securely transmitted to Town Surgery NY PLLC or other independent physician entities solely for patient communication and scheduling.
With Business Associates and Service Providers: Vendors providing administrative, IT, hosting, billing, or marketing services under written confidentiality and HIPAA Business Associate Agreements.
For Legal Compliance: To comply with subpoenas, court orders, or lawful investigations.
For Safety and Security: Where disclosure is necessary to prevent harm or fraud, or to protect legal rights.
Business Transitions: In case of merger, reorganization, or transfer of Town Group assets, provided privacy safeguards remain intact.
Town Group does not sell, lease, or trade your personal or health information for any purpose.

Where applicable (e.g., EU, UK, or other jurisdictions), processing of personal information may rely on one or more of the following lawful bases:

Requests regarding PHI must be directed to the applicable physician practice (e.g., Town Surgery NY PLLC), as Town Group does not maintain medical records for clinical use.
10. Children’s Privacy
Our Websites are intended for adults. We do not knowingly collect information from individuals under the age of 16. Parents or guardians who believe information has been inadvertently collected should contact us immediately.
11. Marketing and Communications
Town Group may send limited marketing or promotional communications only with your express consent. You may opt out at any time by using the unsubscribe link in emails or contacting us directly.
12. California Consumer Privacy Act (CCPA)
California residents may request information on the categories and sources of personal data collected, or request deletion of personal data, by emailing privacy@doctorsplasticsurgery.com with “CCPA Request” in the subject line.
Town Group will not discriminate against individuals who exercise these rights.

We may revise this Privacy Policy from time to time. Updates will be posted with a new effective date. Continued use of the Websites constitutes acceptance of any changes.

15. Relationship Between Town Group Management LLC and Town Surgery NY PLLC
Town Group Management LLC (“Town Group”) is an independent management services organization (MSO). Town Group provides administrative, business, marketing, operational, and non-clinical support services to independently owned physician practices.
Town Group does not employ physicians, practice medicine, or influence medical judgment. Its employees and agents are not authorized to provide medical care or clinical recommendations. All medical decisions—including consultations, diagnoses, procedures, and treatment plans—are made exclusively by licensed physicians practicing through their own professional entities, including Town Surgery NY PLLC (“Town Surgery”).
When you submit health-related information via our Websites, that information is securely transmitted to Town Surgery NY PLLC or another affiliated medical practice for review. Once received, it is governed by that practice’s HIPAA-compliant Notice of Privacy Practices and handled as Protected Health Information (PHI).
Town Group functions solely as a Business Associate under a written Business Associate Agreement with Town Surgery NY PLLC, allowing it to perform limited administrative tasks involving PHI while maintaining compliance with HIPAA, HITECH, and New York State corporate practice of medicine laws.
This separation ensures that Town Surgery NY PLLC retains full and independent control over medical decision-making, while Town Group provides non-clinical administrative infrastructure. This structure is designed to safeguard patient privacy, maintain physician independence, and comply with all applicable federal and state laws.
16. HIPAA Notice of Privacy Practices (Town Surgery NY PLLC)
When you share medical or health-related information through our Websites, it may be transferred to Town Surgery NY PLLC, a professional medical entity subject to the Health Insurance Portability and Accountability Act of 1996 (HIPAA).
Under HIPAA, Town Surgery NY PLLC:
May use or disclose your PHI for treatment, payment, and healthcare operations.
Will not sell or use your PHI for marketing without your written authorization.
Provides you rights to access, correct, and restrict disclosure of your PHI.
